Nursing Home Negligence
Nursing home negligence is a widespread problem in the United States. Many residents of nursing homes depend on the staff for most or all of their needs. Sadly, many residents are starved, dehydrated, over-medicated, or suffering from painful bed sores. Because the staff is often shorthanded and poorly trained, care givers are overworked and underpaid which results in rude and abusive behavior to vulnerable residents. Residents are often isolated, ignored and deprived of social contact and stimulation.
Nursing home negligence can occur in any of the following manners: assault, battery, sexual assault, sexual battery, rape, unreasonable physical constraint or prolonged or continual deprivation of food or water, and use of a physical or chemical restraint or psychotropic medication for any purpose not consistent with that authorized by the physician.
Nursing home negligence is meant to be avoided by imposing heavy licensing and regulation under both federal and state laws. Nursing homes are supposed to protect elderly residents from harm. A gap often exists between the reality of nursing home performance and legal standards. To close that gap, there must be better enforcement and more adequate penalties.
